1. About These Terms
These Terms of Service ("Terms") govern your access to and use of Eye Learn (the "Service", "we", "us"), an independently operated service, not a registered company. By creating an account, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
2. The Service
Eye Learn is a flashcard based study application that uses spaced repetition and artificial intelligence to help you create and review study material. Some features, including AI generated flashcards, require a paid subscription.
3. Eligibility and Account Registration
You must be at least 13 years old to create an account. If you are under the age of majority in your country, you may only use the Service with the involvement of a parent or legal guardian. You agree to provide accurate information when registering and to keep your login credentials confidential. You are responsible for all activity that happens under your account.
4. Subscriptions and Billing
Eye Learn offers a free plan and paid subscription plans, billed monthly or annually. Paid subscriptions automatically renew at the end of each billing period unless canceled before the renewal date. You can cancel automatic renewal at any time from your account's billing settings, which stops future charges while letting you keep access through the end of the period you already paid for. Prices are shown in your local currency where available and may change with notice; changes will not affect a billing period you have already paid for.
5. Your Right to Cancel and Get a Refund (7 Day Guarantee)
If you are not satisfied with your paid subscription for any reason, you may cancel it and receive a full refund within 7 calendar days of your purchase, no justification required. This applies to every customer of Eye Learn, regardless of where you live. To exercise this right, cancel from your account's billing settings within the 7 day window, or contact us at eyelearns@gmail.com; a full refund of the amount charged will be issued to your original payment method and your subscription will be canceled immediately. After the 7 day window has passed, cancellations stop automatic renewal but do not carry an automatic refund for the current billing period, and you keep access through the end of that period.
6. AI Generated Content
Eye Learn uses third party artificial intelligence services to help generate flashcard content from text you provide. AI generated content may contain mistakes, be incomplete, or occasionally be inaccurate. It is provided to support your studying, not as a substitute for verified educational material, and you should review AI generated flashcards before relying on them.
7. Acceptable Use
You agree not to use the Service to upload unlawful, infringing, or harmful content, to attempt to gain unauthorized access to the Service or other users' accounts, to interfere with the Service's normal operation, or to use the Service in a way that violates any applicable law.
8. Account Termination
You may delete your account at any time from your account settings; this permanently removes your data as described in our Privacy Policy and cancels any active subscription. We may suspend or terminate an account that violates these Terms or that we reasonably believe poses a risk to the Service or other users, with notice where practical.
9. Intellectual Property
Eye Learn and its original content, features, and branding are owned by its creator. You retain ownership of the study content you create or upload. By using the Service, you grant us a limited license to store, process, and display that content solely to provide the Service to you.
10. Disclaimers and Limitation of Liability
The Service is provided "as is" without warranties of any kind, express or implied. To the maximum extent permitted by law, Eye Learn will not be liable for any indirect, incidental, or consequential damages arising from your use of the Service. Nothing in these Terms limits any right that cannot be limited under applicable consumer protection law.
11. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you, for example by email or an in app notice, before the changes take effect. Continuing to use the Service after changes take effect means you accept the updated Terms.
12. Governing Law
These Terms are governed by the laws of Brazil. Any dispute arising from these Terms or your use of the Service will be subject to the jurisdiction of the Brazilian courts, without prejudice to any mandatory consumer protection rights you may have under the law of your own country of residence.
